Bartlit Beck Secures End of Consumer Fraud MDL for DuPont

05.2009

In May 2009, the District Court for the Northern District of Iowa entered an order dismissing 22 putative class actions brought against DuPont by purchasers of nonstick cookware.  The court previously denied plaintiffs' request that their cases be certified as class actions, in a ruling that the United States Court of Appeals for the 8th Circuit declined to hear on a petition for appeal.  The dismissal order brought final closure to these cases, in which plaintiffs alleged consumer fraud in the marketing of cookware made with DuPont's Teflon® brand nonstick coating and claimed more than $5 billion in damages.  Representing DuPont in the matter were Adam Hoeflich, Sean Gallagher, Kaspar Stoffelmayr, Rebecca Weinstein Bacon, Carolyn Frantz, and Martha Pacold.
