Mark Ferguson and Mike Valaik lead Bartlit Beck team in HP's bench trial victory over Oracle in San Jose Superior court

Our client Hewlett-Packard won a major victory against Oracle Corporation in its lawsuit in the Superior Court of California for Santa Clara County arising out of Oracle's decision to cease porting its software to HP's Itanium server platforms.  Bartlit Beck partners Mark Ferguson and Mike Valaik led the Bartlit Beck contingent of HP's trial team in the 3-week bench trial in San Jose.  The Court held in favor of HP and against Oracle on all matters submitted, ruling that Oracle was contractually bound to continue porting its software so long as HP continued to offer Itanium servers.  The Court will shortly schedule the matter for a second phase jury trial to address damages and other remedies.
