Fred Bartlit, Glen Summers and Sean Grimsley Win Complete Defense Verdict for Covidien in $400 Million Patent Infringement Action
Fred Bartlit, Glen Summers and Sean Grimsley win a complete defense verdict for the U.S. Surgical division of Covidien Ltd. in a landmark patent infringement case. After a five-week trial in the U.S. District Court for the Central District of California, the jury unanimously found that U.S. Surgical's current "trocar" products (devices used to access the abdomen during minimally invasive surgery) do not infringe a patent held by California-based Applied Medical Resources Corporation. Prior to Bartlit Beck's involvement, U.S. Surgical had lost two earlier patent infringement suits by Applied Medical involving the same patent and earlier versions of the same products. The earlier judgments against U.S. Surgical had resulted in injunctions and substantial monetary damages. According to Wall Street observers, Bartlit Beck's victory in this unprecedented third round of litigation between the parties eliminates up to $400 million in potential financial exposure for Covidien.
