Bartlit Beck Wins Important ANDA Trial For Bayer & Merck KGaA

Scott McBride, with Rebecca Horwitz and Faye Paul Teller, have obtained a complete trial victory for Bayer and Merck KGaA in ANDA litigation over Bayer's Beyaz® and Safyral® oral contraceptive products. The patent-in-suit, owned by Merck KGaA affiliate Merck & Cie, covers Metafolin®, a folate included in Beyaz® and Safyral®. Judge Richard Andrews of the District of Delaware issued an opinion finding the asserted claim of the patent-in-suit valid in the face of four separate challenges by the generic, Watson.
