Honeywell $46.58 Million Jury Verdict Overturned, IP Law 360, Mark Levine and Chris Lind Win Remand Trial
Bartlit Beck partners Mark Levine and Chris Lind, along with Brian Swanson, successfully defended the Hamilton Sundstrand division of United Technologies Corporation in a patent infringement suit brought by Honeywell in the District of Delaware. The case was remanded to the district court after Hamilton Sundstrand appealed a previous finding of infringement under the doctrine of equivalents and a $46 million jury verdict. Bartlit Beck was hired to handle the trial on remand. Upon hearing the evidence at trial, the court ruled that Honeywell was not entitled to the previous jury award because it was estopped from asserting the doctrine of equivalents based on the prosecution of its patents in the United States Patent and Trademark Office.
