Nevin Gewertz, Andrew MacNally, and Cindy Sobel secured a victory for our clients, the former founders, employees, and early investors of FanDuel. On Thursday, May 23rd, the New York Court of Appeals revived a suit filed by Bartlit Beck that seeks damages for breaches of fiduciary duties by former members of the FanDuel board of directors and late-stage investors during a 2018 multi-billion-dollar merger. The Court reversed the intermediate appellate Court’s decision to dismiss the case, reinstating the claims for breach of fiduciary duty under Scots law.
